The preventive suspension order against Mayor Reynaldo Tuanda of Jimalalud in Negros Oriental cannot be served without an original copy from the Sandiganbayan.
Assistant provincial administrator Froilan Pinili said the Capitol has no official records to show that it has received a copy of the suspension order against Tuanda, for the governor to implement.
The order was reportedly addressed to former Gov. Roel Degamo for him to implement the suspension but there is no record of its receipt.
Pinili said he was informed that the order arrived Oct. 13, but Degamo could not serve it anymore because he was also served with a preventive suspension three days after, or on Oct. 16.
Pinilitook initiatives to secure a copy of the order from the Department of Interior and Local Government and wrote a letter of endorsement to acting governor Edward Mark Macias.
But a lawyer in the provincial board said the order cannot be served because the copy came from the DILG, and should officially come from the Sandiganbayan.
Pinili also expressed surprise why the governor was directed to implement the preventive suspension order when it is the job of the DILG.
Macias said he will implement the order as soon as he receives the official document, but he and Pinili had no idea whyTuanda was being preventively suspended.*JG
