The Department of Environment and Natural Resources - Environmental Management Bureau is just waiting for the mayor to recommend which barangay should be penalized for violating R.A. 9003 or the Ecological Solid Waste Management Program, Joan Nathaniel Gerangaya, Bacolod Community Environment and Natural Resources Officer, said yesterday.
It is the DENR-EMBthat is supposed to file charges against erring barangay captains who do not comply withR.A. 9003, he said.
Gerangaya said that after an evaluation on the compliancewith R.A. 9003,it was found out that there are still barangays who do not segregate their waste.
It is the regional director of EMB who should file the case, but they have not determined the status of the erring barangays, he said.
Gerangaya said the list of erring barangays submitted to them will be evaluated before it will be submitted to the EMB Regional Office, again for evaluation and the filing of a case.
The law should have been complied with years ago, he said.
Head officials of the DENR have been summoned to Iloilo today for the review of the implementation of R.A. 9003, so the participation of field offices will be made full time.As of now, it is only the EMB that implements environmental laws, especially on the assessment of compliance of R.A. 9003, Gerangaya said.
With the instruction of Environment Secretary RoyCimatu to involve field officials in the evaluation, their monitoring could be more effective, especially the recommendation on erring barangay officials who do not follow the law, he said.
Gerangaya said R.A. 9003 imposes a penalty of imprisonment on violators. In the case of local officials, they will be banned from running for public office if they do not implement the law.*CGS
