| The Supreme Court recently ruled in favor of Bank of the Philippine Islands and upheld the decisions of the National Labor Relations Commission and the Court of Appeals in the case of dismissed employees Amelia Enriquez and Remo Sia, BPI Bacolod manager Paciano Paciente said yesterday.
Paciente said that the Court in its February 12, 2008 decision, ruled that the bank has every right to dismiss Enriquez and Sia for breach of trust, loss of confidence and dishonesty.
The decision stated that the fact that both employees worked for BPI for a long time, if it is to be considered at all, should be taken against them, Paciente said.
He added that the SC ruled that Enriquez’s and Sia’s manifest condonation and even concealment of an offense prejudicial to their employer’s interest reflect a regrettable lack of loyalty which they should have reinforced, instead of betrayed.
Enriquez and Sia has filed a complaint of illegal termination before the NLRC after they were dismissed from work by BPI on September 3, 2003.
They questioned the legality of their dismissal initially obtaining a ruling in their favor from the labor arbiter. However, this was later overturned by both the NLRC and the Court of Appeals.*NAB
