SC upholds contempt order

The Supreme Court has affirmed the ruling of a Bacolod Regional Trial Court citing a Bacoleño guilty of indirect contempt of court, after denying a petition for review on certiorari of a Court of Appeals decision.

On Feb. 13, 2004, Judge Gorgonio Ybañez found Humberto Lim Jr. of Helvetia Heights Subdivision in Bacolod City guilty of indirect contempt of court and directed him to pay a fine of P20,000 with subsidiary imprisonment in case of insolvency, and sentencing him to an imprisonment of five days.

The CA dismissed the appeal filed by Lim and affirmed the order of Ybañez.

The CA decision said that the lower court had found the act of Lim of swamping the court with various letters and pleadings containing a cannonade of accusations and malicious imputations as to the partiality of the court utterly contemptuous, adding that a perusal of the letters and pleadings  in question “leads us to the same conclusion.”

“His words reveal utter disrespect to the court,” the CA said.

Lim then filed a petition for review on certiorari of the CA decision before the SC.

The SC denied the petition for Lim “for failure to sufficiently show that the appellate court committed any reversible error in the challenged decision and resolution”.*CPG
