If he meant what he said, then he should allow the Department of Agrarian Reform to proceed with CARP coverage, process the claim folder, and distribute the property, Angeles said.
The Vera Files report said Arroyo had denied that he was using the Biofuels Act of 2006, which he co-authored, to exempt Hacienda Bacan from CARP by having it converted from agricultural to agro-industrial uses, mainly for ethanol production.
It also stated that DAR records show the planned construction of an ethanol plant in the hacienda was in line with its conversion from agricultural to industrial uses.
In the same press statement, Angeles said that any move to convert the property is illegal because it does not have the required certification from DAR saying that the property is free of any claim or petition for distribution under CARP.
He added that the property had been placed under CARP coverage in 2000 through compulsory acquisition and the following year, Arroyo offered it to CARP under the voluntary offer to sell scheme after President Gloria Macapagal-Arroyo announced that she will redistribute the Arroyo landholdings.
Angeles also said a claim folder for the property had been prepared by DAR and submitted to the Land Bank for valuation, but it was returned to DAR because the offer should have been made by First Gentleman Mike Arroyo, whose name appeared in the documents as true owner of the property, the TFM statement added.*
