Acting Labor and Employment Secretary Marianito Roque said today, April 7, is a regular non-working holiday nationwide in observance of the Araw ng Kagitingan on April 9.

Roque said that Proclamation No. 1463 issued by President Gloria Macapagal Arroyo provides for the commemoration of the Araw ng Kigitingan two days ahead of the official date in line with R.A. No. 9492, which provides that holidays, except those which are religious in nature, are moved to the nearest Monday unless otherwise modified by law, order, or proclamation.

He said that moving the observance of the Araw ng Kagitingan on April 7 shall allow the public especially the workers to spend more time with their family while remembering the period in the country's history when 75,000 Filipino and American soldiers displayed valor and heroism in Bataan on April 9, 1942.

Roque said that the holiday pay rules, supposedly applicable for April 9, shall be applied instead on April 7.

Workers should be paid 100 percent of their regular salary for that day if it is the workers' regular workday and the day is unworked.

If worked, 200 percent shall apply for the first eight  hours, and for work in excess of 8 hours, plus 30 percent of the hourly rate for the said day.

If the day falls on an employee's rest day and is unworked, 100 percent of the regular daily rate shall apply. If worked, the employee shall receive 230 percent of the regular daily rate for the first 8 hours, and for work in excess of 8 hours, plus 30 percent of the hourly rate for that day.*
