mayor appealed

A losing mayoralty candidate has filed a motion for reconsideration to the Commission on Elections First Division dismissal a petition for disqualification of Toboso Mayor Evello Valencia Jr..

The motion was filed by Toboso Mayor Albino de la Cruz, Elections Provincial Supervisor Jessie Suarez of Negros Occidental said yesterday. Acting on the motion, Commissioner Resurreccion Borra has ordered that the entire records of the case be elevated to the Commission en banc.

Valencia won a second term as mayor of Toboso in the May 14. polls.

The COMELEC First Division, in a four-page resolution penned by Borra and commissioner Romeo Brawner, had said Valencia provided sufficient proof that his nationality is Filipino and he is no longer a US citizen or immigrant. However, de la Cruz, in his petition said Valencia materially misrepresented himself in his Certificate of Candidacy as a Filipino when he was not.*CPG
