The mother of landowner Magdaleno Peña has issued an affidavit
of disclaimer stating that she has not authorized anyone to eject
people occupying property she co-owns in Pulupandan town.
Lina Montilla Peña, in her affidavit, said she is co-owner
of several lots in Pulupandan town in the name of SLC Farms.
SLC stands for Soledad Montilla - her mother, Lina - herself
and Candido Montilla - her brother, she said.
As co-owner "I have not authorized any person to file any case
for ejectment against any person or persons who are occupying the
said lots," she said.
Her son, Magdaleño, has filed ejection cases in court to seek
the removal of about 2,000 houses of people he said are squatting
on property he and his family own.
His mother, in her affidavit, said that the cases that have
already been filed, including those that will be filed later against
the lots owned by SLC, are without her authority and should be outrightly
dismissed.
But Peña yesterday said his mother does not have any say since
he has majority control over SLC Farms.
"I control two-thirds, she is a mere minority," he said of
his mother.
Peña said he is the administrator of the estate of his grandmother,
Soledad, and the legal guardian of his uncle, Candido.
"They both refused to have anything to do with Lina," he claimed.
Peña said his mother was not happy that control of the estate
was turned over to him by his grandmother in the 1990s.
Peña said SLC Farms only owns 5 percent of the Pulupandan poblacion
while the 75 percent is owned by his other relatives who have commissioned
him to eject the squatters from their lands.*CPG
