| A motion to file and admit amendments to the compromise agreement
was filed by the Bacolod Real Estate Development Corp. yesterday before the Regional
Trial Court, Rosellier Maalat, one of the lawyers of BREDCO said. BREDO
had agreed Tuesday to a compromise agreement with the Philippine Ports Authority
during the hearing of the injunction case it had filed against the PPA for revoking
its permit to operate. PPA revoked the PTO of BREDCO after it failed to explain
why it has charged higher tariffs without its approval. Maalat said the
court will set a hearing on the matter to give the parties an opportunity thresh
out or settle their differences. He said they want to amend the language
of the agreement involving the port rates. Maalat said they believe BREDCO,
which is a private port, should not be bound by the rates imposed in the Pulupandan
port, which is owned by the government. He said he hopes PPA will impose a rate
that is appropriate. "We will comply with whatever rates are imposed by
PPA," he said. Maalat said the injunction case they have filed against
PPA will be dismissed by the court once they have accomplished the compromise
agreement. With the revocation of BREDCO's PTO, the corporation has to
pay PPA 100 percent of the wharfage/usage fees it collects instead of only paying
50 percent. PPA will also get from BREDCO 10 percent of the gross of the arrastre/stevedoring
