| Provincial supervisor Jessie Suarez of the Commission on Elections
has been directed to investigate five election related cases in Negros Occidental.
COMELEC Regional Director Renato Magbutay directed Suarez to investigate
the cases of Jose Nadie Arceo vs. Angelito Colmenares, Genaro Alvarez vs. Roger
Gasataya et. al, Tranquilino Carmona vs. Julio Ledesma, et. al., Remus Bayawa
vs. Manuel Bayawa, and Albino de la Cruz vs. Evello Valencia III. Suarez
was ordered to conduct a formal investigation only for the purpose of ascertaining
the truth and without necessarily addressing to the judicial rules applicable
in judicial proceedings, Magbutay said. Suarez was also directed to come
up with resolutions after the investigation and to send them, along with the records
of the cases, to the COMELEC Law Department, Magbutay said. Arceo who won as vice
mayor of Hinigaran had filed the case against his opponent Colmenares for allegedly
entering polling precincts in Tuguis, Hinigaran, during the 2001 elections.
Alvarez who won as congressman of the sixth district had filed the case against
Roger Gasataya, et al. of the Kabankalan City Board of Canvassers sub canvassing
committee for allegedly increasing the votes of his opponent. Carmona who
lost to Ledesma in the race for congressman of the first district of Negros Occidetnal
had filed the complaint for alleged violation of the rule on posting campaign
materials, COMELEC records show. SPO1 Remus Bayawa, on the other hand,
filed a complaint against his father Manuel Bayawa, 66, for possession of a firearm
in San Carlos City on May 13 in violation of the COMELEC gunban. And dela Cruz
who lost the mayoralty race in Toboso to Valencia had questioned his citizenship.*CPG
