The Commission on Elections First Division has dismissed a petition for the disqualification of Rep. Jeffrey Ferrer (Neg. Occ, 4th district) for the illegal posting of campaign materials before the May 14 elections, Provincial COMELEC Supervisor Jessie Suarez said yesterday.

Fourth district congressional candidate Jorge Camposano had filed the petition for the disqualification of his opponent on May 2.

Camposano cited the Election Reform Law of 1987 stating that election propaganda materials should be posted at common poster areas designated by the COMELEC.

Since the campaign period began, Camposano said Ferrer had been posting his campaign materials all over the fourth district, outside the common poster areas. He said many of these materials had sizes that violated the specifications set by the COMELEC for billboards and campaign posters, while others were posted in trees in violation of existing DENR and COMELEC regulations.

The COMELEC First Division, however, dismissed the complaint of Camposano for lack of jurisdiction, Suarez said.

The COMELEC ruled that disqualification cases regarding members of Congress fall within the jurisdiction of the House Electoral Tribunal, he added.*CPG
