Probable cause found
vs. Descallar: PDEA
The Philippine Drug Enforcement Agency yesterday
said it has found probable cause for filing criminal charges against
Chief Inspector Jefferson Descallar for violation of Section 92
of RA 9165, allegedly for the delay in filing of drug charges against
two arrested drug peddlers in Cadiz City.
Supt. Rolen Balquin, former regional anti-narcotics
chief, said PDEA will also determine if Descallar has committed
serious neglect of duty. Delay in filing of drug cases within the
reglamentary period of detention of arrested drug suspect is punishable
under Section 92 of RA 9165 with a penalty of a maximum of 20 years
of imprisonment, while dismissal from the police service if convicted
for serious neglect of duty, Balquin said.
The seven Cadiz policemen and Descallar were
ordered by Balquin while he was still as PDEA regional chief, to
explain the delay in filing of drug cases against Ricardo Cayapado
and Renante Aladin, within the reglamentary period of detention.
Descallar blamed the delay in the immediate filing
of drug cases to the unavailability of Cadiz City Prosecutor Marcelo
del Pilar, whom he claimed had failed to report to his office from
June 4 to 8.
Del Pilar, however, refuted this, saying he reported
to his office from June 4 to 8, as he was even able to handle the
inquest case of PO1 Rafael Gargar vs. Pepito San.
The failure of Descallar to immediately file
drug cases had prompted him to release Cayapado and Aladin whom
they had arrested on June 1 for violation of RA 9165, known as the
Comprehensive Drug Act of 2002, to avoid being charged for arbitrary
detention.
The arrest of Cayapado, a suspected big time
shabu pusher in Cadiz City, and Aladin, led to the recovery of shabu
estimated to have a market value of not less than P100,000, police
records show.
Balquin said he has endorsed the case of Descallar
to his successor, Supt. Roybel Sanchez, which is expected to be
filed in court next week.
Descallar and three other policemen are also facing
complaints before the Office of the Visayas Ombudsman, which was
filed by the Commission on Human Rights, in connection with the
arrest of civilian mistaken as among the 10 most wanted persons
in Western Visayas.*GPB

filed in slay
of Bago woman
Police have filed attempted rape with homicide charges
against a man who was allegedly behind the attempted molestation
and murder of a grocery store cashier in Bago City, Negros Occidental.
Bago police chief Alex Belonio said the filing
of charges against suspect Ramiro Hele, alias Ramy, was based on
the positive identification of a witness, that was behind the hold-up
slay of Jenniver Pelingon. Police investigations show that Hele
also tried to molest Pelingon, as her pants and underwear had been
pulled down. However, a post-mortem report showed that she had not
been molested.
The bag of Pelingon was also missing, indicating
that she had been robbed, police investigations also showed.
Hele who was previously charged for the rape
of his sister-in-law in year 2000, vehemently denied that he killed
Pelingon at Km. 14 in Brgy. Calumangan, Bago City.
On the other hand, the Bago and Talisay police
probers are still more gathering evidences to pin down suspects
in the rape-slay of Mary Joy Mayo, 16, and Ma. Teresa Medrano, 13,
last month.
Chief Inspector Joseph Thomas Martir, Talisay police
chief, yesterday said a witness came to the police, to help them
in identifying suspects in the rape-slay of Mayo, a first year college
student of Carlos Hilado Memorial State College in Talisay City.*GPB

3 injured
in brawl,
stabbing in Bacolod
Three persons were injured in mauling incidents in
Bacolod City early yesterday, the police said.
Melchor de la Cruz, 31, sustained wounds on his
forehead and was rushed to the Corazon Locsin Montelibano Memorial
Regional Hospital while Ryan Depositario, 32, had injuries on his
face and was brought to the Bacolod City Adventist Medical Center
yesterday, police records showed. De la Cruz and Depositario were
injured when a brawl broke out between their friends at Siocon Road,
Brgy. 26, Bacolod City at abut 1 a.m. yesterday, police reports
said.
Meanwhile, Arthur Deloso, 17, reported to Police
Station 4 that three minors waylaid and stabbed him while he was
on his way home yesterday after buying food from a restaurant.
Deloso told the police that a certain "Ping-Ping",
"Nony Adcor", and "Jojo" blocked his bike, stabbed and slightly
injured him on his chest, at Galo Street, Brgy 20, Bacolod City
at about 2 a.m. yesterday.
He left his bike and ran, and said that he heard
gunshots behind him, police reports said. The police said that they
are still investigating the incidents.*PP
