The Court of Appeals issued a temporary restraining order effective
for 60 days, unless sooner lifted by the Court, enjoining the Civil
Service Commission to refrain from implementing, enforcing or executing
Resolution No. 051727 and 061312, as well as any writ in connection
with the case involving the appointment of City Legal Allan Zamora.
The case was promulgated by the CA 18th Division on June 14.
Resolution 051727 refers to the invalidation of the appointment
Zamora as City Legal Officer, while Resolution 061312 refers to
the denial of the motion for reconsideration filed by Mayor Evelio
Leonardia on the order of the CSC to implement the decision to invalidate
Zamora's appointment.
Executive Justice Arsenio Magpale, in his resolution, said
the Court is of the view that the prayer for the issuance of a TRO
is reasonably justified.
First, the assailed judgments, Resolutions 051727 and 061312
dated Dec. 5, 2005 and July 18, 2006, respectively, issued by the
CSC are now the subject of execution, he said, and secondly, there
is a clear showing that the petitioner applicant will probably suffer
irreparable damages in the event that an execution has been or is
pursued.
Magpale has ordered that a TRO be granted in order to preserve
the rights of the parties during the pendency of the petition for
review, as well as, to prevent the judgment that may be promulgated
in this case from being rendered ineffectual.*CGS
