The Civil Service Commission has denied a motion for reconsideration
filed by Escalante Mayor Santiago Barcelona to an order directing
him to reappoint 14 employees in the new staffing pattern of Escalante
City under its reorganization.
The CSC resolution denying the motion for Barcelona directed
him to pay the backwages and other benefits of drivers II Emerson
Bermejo and Eduardo Bacaron, utility workers II Diolito Albento,
Joseph Demalerio, Rodolfo Pritos, Amelia Villa, Aurelio Pios, Rodolfo
Api, Norma Jose, Silva Bacaron, Noel Dueñas and Edna Abibas, day
car worker I Gloria Tan and labor foreman Constantino Dueñas.
The CSC order dated Jan. 8 was signed by CSC chairman Karina
Constantino David and Commissioners Cesar Buenaflor and Mary Ann
Fernandez -Mendoza. Barcelona yesterday said he has raised the CSC
ruling to the Court of Appeals.
Barcelona argued that the CSC erred in not finding that Bermejo
et. al. were guilty of willful and deliberate forum shopping.
Their security of tenure was never violated because when he
ordered the implementation of the reorganization all positions were
considered abolished by operation of law, Barcelona pointed out.
The abolition of the positions of Bermejo et. al. was done
in good faith and they were offered separation pay in accordance
with the standards set under Republic Act 6656, he argued.
But the CSC said the issues raised by Barcelona were the same
ones in his appeal and no new evidence was submitted to provide
grounds for the Commission to modify or reverse its resolution.*CPG
