Oti motion for execution up
for Comelec resolution

The motion of Jose "Oti" Montelibano for the Commission on Elections First Division to execute its order declaring him the winning mayor of Silay City was submitted for resolution yesterday.

Montelibano said his lawyers and those of Carlo Gamban submitted their arguments before the COMELEC First Divisiion yesterday.

Gamban who has filed a motion for reconsideration to the First Division's ruling declaring Montelibano the winner of the May 2002 Silay mayoralty race before the Comelec en banch is opposing the Montelibano's motion for execution. Montelibano obtained 19,392 votes, or a plurality of 138 votes over Gamban's votes of P19,254, the COMELEC First Division said.

If the First Division grants his motion for execution, Montelibano said, he will be able to sit as mayor of Silay City while the COMELEC en banc decides on the motion for reconsideration filed by Gamban.

Gamban, on the other hand, pointed out that he is the rightful and legitimate winner of the May 11, 2004 Silay City election for mayor.*CPG
