Convicted Silay drug pusher Ramil Golez is on his way back again to the National Penitentiary at Muntinlupa after he was meted a maximum of 14 years by Judge Felipe Banzon for violation of Section 11 of Republic Act 9165, known as the Comprehensive Drug Act of 2002, police said.

SPO2 Dante Victor Escorpion, former chief of the Silay police Anti-Drug Enforcement Unit, yesterday said Golez was released from the national penitentiary in November 2002, after serving his sentence for violation of RA 6425, known as the Dangerous Drug Act of 1972. He was arrested and recently convicted again for a similar violation by Banzon.

Police records show that before his latest conviction, Golez had been arrested thrice by the Silay police for illegal possession of drugs.

Court records indicate that Golez was arrested after a team of policemen led by Escorpion raided his residence in Purok Mainuswagon, Brgy. Guinhalaran, Silay City in August 25 last year, for violation of RA 9165.

The raid yielded two sachets of shabu hidden in a pillow.

Escorpion recalled that Golez grabbed the two recovered sachets of shabu, placed it in his mouth, chewed and tried to swallow it, while he was about to be handcuffed by policemen.

Golez was later noticed by PO1 William Abellar, a member of the police raiding team, to have spat out the crumpled sachets of shabu, which were later recovered by the Silay police.

Golez had claimed that Escorpion rammed the sachets into his mouth.

In his decision, however, Banzon said the assertion of Golez had not been substantiated, nor was it validated by evidences sufficient to a logical belief of its veracity and truthfulness.

“There was hardly a significantly credible effort on the part of the defense to show that, indeed, the accused (Golez) was merely framed by the concerned police officers nor had the defense endeavored or in the very least, tried, to establish that the police officers had ill motive in the conduct of the questioned search”, he added.

Aside from the 14 years imprisonment, Banzon also ordered Golez to pay a fine of P300,000, as stipulated in Section 11 of RA 9165.*GPB
