| Two persons were meted life imprisonments and ordered to pay a fine of P400,000 to P500,000 for drug charges yesterday by the Regional Trial Court Judge Rafael Crecensio Tan Jr., in Barangay Piapi, Dumaguete City
The court found Manny Misamis guilty beyond reasonable doubt for illegal possession of 16.71 grams shabu and illegal possession of equipment, instrument, apparatus and other paraphernalia for dangerous drugs.
Such acts violate sections 11 and 12, Article II of Republic Act No. 9165 or the Comprehensive Dangerous Drugs Act of 2002, the court said.
Court records show that on June 12, 2005, operatives of the National Bureau of Investigation and the Dumaguete City police office went to Upper Lukewright , in Barangay 2 to serve a search warrant against Misamis.
They seized from the place an improvised tooter, one plastic sachet of shabu containing 16.71 grams, 12 empty transparent plastic sachets and P870, believed to be proceeds from the sale of shabu
The court said it scrupulously examined the testimonies of the authorities and found them to be categorical and candid, untainted by any contradictions or evasions.
Meanwhile, also meted life imprisonment was Mario Estores who was arrested on Nov.9, 2004, in a buy-bust operation by the police at Merciano Road , Dumaguete.
Court records disclosed that a poseur-buyer parked his motorcycle and approached the accused, who immediately asked him how much he would buy.
The poseur buyer handed the P1,000 in marked money to the accused who accepted it. About 10 to 15 seconds later, the police arrived and arrested Estores.
Estores, along with the seized items, was brought to the Philippine Drug Enforcement Agency office, which filed the case against him.
The court said it found Estores guilty of the illegal sale of 0.22 gram of shabu, in violation of Section 5, of the anti-drugs law.*RG
