DILG issues clarification
on brgy, SK ex-oficios
 

Secretary Ronaldo Puno of the Department of the Interior and Local Government yesterday said that the terms of office of the Liga ng mga Barangay Sangguniang Kabataan Federation presidents who are ex-oficio members in the different sanggunians at all levels expired Oct. 29, the date of the barangay and SK elections, a DILG press statement said.

Puno made the clarification after the Department received numerous queries regarding the term of office of the Liga ng mga Barangay Federation presidents at all levels and their ex-oficio membership in their sanggunians.

He said there is also a need to harmonize and reconcile the different provisions of the Constitution and By Laws of the Liga ng mga Barangay, Local Government Code of 1991, and RA 9340, particularly those that refer to the hold-over rule and the ex-oficio membership of the Liga ng mga Barangay and SK Federation Presidents in the sanggunians.

The DILG Secretary also said all incumbent municipal, city and provincial Liga presidents are allowed to hold over as Liga presidents until their successors have been elected and qualified in their Liga chapter elections.

However, in accordance with Section 3 of RA 9340, he said their term of office as ex-oficio members of sanggunians expired on October 29, 2007.

As hold-over Liga presidents, however, Puno said in his statement that incumbent Liga chapter presidents will convene the newly elected punong barangays for the purpose of conducting their Liga chapter elections.

He said that after the election of the Liga chapter presidents, within 30 days from their assumption, the duly elected chapter presidents shall sit as ex-oficio members of the Sanggunian concerned.

Puno also said that all incumbent Liga presidents who continued to serve as ex-oficio members of their sanggunians after October 29, 2007 up to the issuance of this Advisory are considered de facto officers, the press statement added.*
