Peņa: Recto hasn't won
temporary custody yet

Pulupadanan Mayor Magdaleno Peņa yesterday said his former live-in partner, Plinky Recto, has not won temporary custody over their 3-year-old son yet, as he is filing a motion for reconsideration before the Supreme Court to clarify the matter as soon as he gets his copy of its resolution.

Peņa said he is challenging Recto to show a copy of the SC resolution granting her temporary custody pending trial. We have not yet started the custody trial, we are only at the stage where we are fighting for its venue - Negros Occidental or Mandaluyong, he said.

What was recently dismissed by the Mandaluyong Regional Trial Court on July 12 was the case filed by Recto against him for violation of Republic act 9262 or for Violence Against Women and Children, he said.

Since the Mandaluyong case has been terminated where will the custody trial now be held? he asked.

Maybe Recto wants to hold the trial at the Court of Appeals in Manila where she already elevated the VAWC case, he said.*CPG
