The Regional Trial Court decided yesterday to submit for resolution
the application for the issuance of a temporary restraining order
filed by Allan Zamora during the hearing of the case involving the
invalidation of his appointment as Legal Officer of Bacolod City.
RTC Judge George Patriarca also scheduled for hearing the application
for the issuance of a writ of preliminary injunction filed by Zamora
on May 4.
Zamora had filed last week a petition for prohibition with
prayer for the issuance of a temporary restraining order/ or writ
of preliminary injunction against Imelda Abueg and Raymund Gonzales,
CSC regional office director VI and director III, respectively,
and the CSC proper before RTC Branch 46. This was after the CSC
issued Resolution 07-0365 dated Feb. 26, 2007 ordering Mayor Evelio
Leonardia to implement the decision on the invalidation of Zamora's
appointment as CLO.
During the hearing yesterday, only Gonzales appeared
to represent himself after he and Abueg had filed a motion for postponement
and asked the Court to transfer the hearing of the case to May 11
since they are still coordinating with the Solicitor General. However,
this was opposed by Zamora yesterday.
Zamora recalled that after the CSC issued the Resolution,
Abueg also issued the mayor an ultimatum of 24 hours to implement
the CSC order. However, the Mayor answered that the CSC has no authority
to order the implementation of the Resolution since its only authority
is to monitor the implementation, based on Resolution 07-0365.
Leonardia had also filed a motion for reconsideration which
is still pending with the CSC.
Zamora said "Let us see if the Solicitor General will represent
them." He believes that what will happen is that the Solicitor General
will deputize the office of the provincial prosecutor to represent
him in the case, he said.*CGS
