Bacoleņo draws 7 years

A Regional Trial Court judge yesterday sentenced
a Bacoleņo to a minimum of one year to a maximum of seven years
for the illegal sale and possession of prohibited drugs.
Judge Ramon Delariarte of RTC Branch 49 in Bacolod
City found Joemer Lumawag guilty beyond reasonable doubt for violation
of Section 15, Article III of Republic Act 6425 or the Dangerous
Drugs Act, and sentenced him to a minimum of six months to three
years.
Lumawag, who was nabbed in possession of 49.46
grams of shabu in a buy-bust operation in Villa Lucasan in Brgy.
Mandalagan in Feb. 29, 2000, got four more years, after Delariarte
found him also guilty of violating Section 16, Article III of RA
6425.
Delariarte also ordered the remittance of the
plastic pack containing the 49.46 grams of shabu marked as No. D-115-2000
taken from Lumawag to the PNP Crime Laboratory for proper disposition.
In his 12-page decision, the judge said the testimony
of SPO1 Arnold Vasquez, who acted as a poseur-buyer of .44 grams
of shabu from Lumawag in the buy-bust operation, was given in a
categorical and straight manner from the time of the operation leading
to the recovery of the prohibited drugs. Lumawag, who had pleaded
not guilty when arraigned in July 13, 2000, invoked the defense
of denial, court records showed.
"The defense miserably failed to establish the ill-motive
on the part of the prosecution, more specifically on the part of
Vasquez to implicate Lumawag in the criminal information," Delariarte

Abduction
raps
filed vs. Murcia man

The Bacolod police will file today charges of abduction
in relation to Republic Act 7610, or the Child Abuse Law, against
a 20-year-old man who reportedly abducted a 9-year-old elementary
pupil in Brgy. Bata, Bacolod City, Tuesday, before the City Prosecutor's
Office.
Case investigator PO2 Rosemae Diaz of the Women
and Children's Concern Desk of Police Precinct 3 yesterday told
the DAILY STAR, the girl yesterday executed her affidavit for the
filing of charges against her alleged abductor, Jailboy Fermisa
of Murcia town, Negros Occidental.
The minor was rescued by her relatives in Brgy.
Mabini, Valladolid town in Negros Occidental Wednesday after a concerned
person saw her in the area, Diaz said.
She added that a medical examination conducted
on the minor disclosed that there was no laceration in the child's
private parts.
Diaz said her investigation showed that Jailboy
had deceived the minor by telling her that her mother had consented
that she accompany him to get his clothes in Valladolid. He then
forcibly brought her to the bus station near the Bacolod Libertad
Market and later to Valladolid, where he allegedly molested her
while she was sleeping in the house of his grandmother.
Diaz said Jailboy is still in the custody of the
San Enrique police station and will be transferred to Bacolod Police
Precinct 3 today.*DMG

Help deter
child molestation,
government agencies urged

A resolution requesting various government agencies
to promote methods that would deter incidences of child molestation
among school children and high school students was proposed by Bacolod
Councilor Greg Gasataya yesterday.
The resolution was directed to the Department
of Education, the Women and Children's Desk of the Bacolod City
Police Office and the Department of Social Services and Development
of the Bacolod City government.
The resolution said there has been a noted increase
of incidents involving molestation of children and cited the case
of three elementary students recently reported to have been molested
by a janitor in an elementary school in Bacolod City. Medical examination
had determined that these elementary students had indeed been molested,
he said.
The resolution also requested the WCCD of the BCPO
and the DSSD to extend all the assistance necessary to the three
elementary students.*CGS
