BACIWA rationing water as
it waits for court order

The Bacolod City Water District is rationing water supply to its concessionaires while it awaits the decision of the court on the temporary restraining order it is seeking against the owners of the Boro-Boro Springs in Brgy. Alangilan, Bacolod City.

Baciwa assistant manager Julie Ann Carbon said the office has received several complaints from concessionaires at the eastern portion of the city about low to no water supply. She said the water in the Baciwa reservoir in Brgy. Granada has reduced greatly since no water from the Boro-Boro Springs is entering it.

Baciwa filed before the Regional Trial Court Tuesday an injunction with prayer for TRO and preliminary injunction and establishment of right of way against the Sausi family, owners of the property, for closing the gate to the only access road leading to the water source.

Baciwa said it received reports Sunday that Spring No. 2 was sabotaged and its water diverted. Its personnel and officers could not enter the property to validate the reports and check the damage in the spring intake box in the Boro-Boro Spring because they could not enter the gate.

Juan Rubrico, lawyer of Edmundo Sausi, also filed on Tuesday a motion to dismiss the case filed by Baciwa, asking that the other heirs be also impleaded, as well as, a reply to the opposition filed by the counsel of the water district. He said that if the judge issues an injunctive relief in favor of Baciwa, and order them to open the gate, the other heirs might not agree.

Rubrico said he has requested the City Legal Office to assist in having the two parties negotiate to resolve the problem. Carbon, meanwhile, said that on Jan. 8 she and other Baciwa officials tried to negotiate with the Sausi family twice but they refused to meet with them. She said their lawyer Jovim Entilla filed an amended complaint impleading Rubrico.

Carbon said she believes the Sausi's are reasonable people and may just have been ill-advised. She said the Baciwa management wrote Mayor Evelio Leonardia asking for assistance and they are thanking the city for its concern over the situation.*CGS
