filed versus Balbon

Charlie Balbon Sr., who remains on top of the list of drug personalities in Silay City, is not yet off the hook even after posting bail of P330,000 on Tuesday for violation of RA 7610, or the Abuse Act.

This is because multiple rape charges were filed against Balbon also on Tuesday before the Silay City Prosecutor's Office, police chief Clestino Guara said yesterday

Guara said the filing of criminal complaints against Balbon stemmed from his alleged molestation of a 12-year-old-girl in Sitio Patuloy, Barangay Mambulac, Silay City from February last year to February 10 this year.

The minor, a grade 5 pupil, said in her complaint affidavit that Balbon put cooking oil on her sex organ before he played with it using his finger in February last year.

The incident was repeated on April 9 last year, when the victim claimed she was molested.

After the two incidents the minor, whose identity is being withheld by the DAILY STAR, further alleged that she was molested several times until February 10 this year.

The next day the victim said she was brought by Balbon to Adam's Lodge in Barangay Bata, Bacolod, City where she was molested again.

The minor also admitted in her affidavit that she was given amounts ranging from P20 to P600 after being "used" by Balbon.

Silay City health officer Sabina Damaso who examined the victim, noted healed lacerations in her sex organ.

Meanwhile, Guara said the minor was also threatened with physical harm by Balbon if she told anybody what he was doing to her.

Charges for rape and violation of RA 9231filed by the Bacolod City PNP, Women's and Children's Concern Desk earlier were dismissed by the City Prosecutor's Office.

Prosecutor Arlene Catherine Dato said she did not recommend the filing of rape charges against Balbon because the presence of force and intimidation were not proven. The minor went with Balbon to the lodge without being forced and intimidated, she added.

However, Dato said Balbon is still facing charges for violation of Republic Act 7610, or Child Abuse and Article 243, or Consented abduction, in court. Balbon was arrested after bringing the minor to the Adam's Lodge in Bacolod City.*GPB
