Boro-boro springs entered

Bacolod City Water District personnel entered the Boro-Boro Springs, in Brgy. Alangilan, Bacolod City yesterday after the Regional Trial Court granted Friday the "urgent motion to break open the gates and other obstacles" they had filed against the owners of the property.

The urgent motion was filed by Jovim Entilla, the legal counsel of Baciwa, after the other owners of the property closed the gate at Lot 1549 on February 5 after allegedly threatening the Baciwa guards.

In his Order, RTC Judge Anastacio Rufon directed defendants Juanito Sausi Jr., Jose Infante and Vicente Villaruz, and all other persons holding the keys to the entrance and exit gates to turn them over to Baciwa or its representatives, and allow the personnel of the water firm unhampered access to all entrance and exit gates, roads, locks found in Lots 1284, 1274, 1017, 1549 and the neighboring lots.

He also directed the Sheriff of the Court to implement the order and enforce the Writ of Preliminary Injunction he issued on January 31, to cause the opening of the gates, roads and locks and other obstacles or hindrances put up by the defendants and any other persons in whatever capacity over the ingress and egress of the lots.

The Sheriff was also directed to break open the steel gates and other obstacles found, if necessary, to clear the way for Baciwa, its officers and representatives, so they could inspect the Boro-Boro Springs and the facilities installed and initiate corrective measures, and redirect the flow of water to the distribution lines.

Rufon also ordered the police to arrest anyone who defies or attempts to defy the Writ of Preliminary Injunction and his Order, or those who cause, or attempt to delay the clearing of the way for Baciwa towards Boro-Boro Springs and the water facilities.

He also ordered the police to secure the area where the springs and Baciwa facilities are found in order to prevent anybody from sabotaging, destroying the same, closing the access roads or contaminate the spring water injected into Baciwa distribution lines and other similar acts, by fielding their men together with the security guards of Baciwa.*CGS
