Bid for inhibition of judge
in BACIWA case opposed

The lawyer of the Bacolod City Water District yesterday filed before the Regional Trial Court an opposition to the motion of the Sausi family for inhibition and asked that it be dismissed for lack of merit.

The Sausis, owners of the Boro-Boro Springs in Brgy. Alangilan, Bacolod City filed Wednesday a motion to inhibit the judge from hearing case filed against them by Baciwa. The motion was filed by Romeo Natino and Juan Rubrico, lawyers of Edmundo Sausi and children.

Baciwa had filed an injunction case against the Sausis before Judge Anastacio Rufon of RTC Branch 52, after they closed the access road leading to the springs.

In his opposition, Jovim Entila, legal counsel of Baciwa, said the motion for inhibition is basically based on conjectures and unfounded accusation of bias.

Entila said the order for the issuance of subpoena to the newly impleaded defendants was immediately recalled by the judge on the same date, Feb. 8 when no harm had yet been done to anybody.

He said this is an error that anybody could commit under time pressure, but not necessarily out of bias or for the purpose of favoring one litigant over the other. He said defendants simply misinterpreted everything.*CGS
