BUT DIRECT ASSAULT CASE PENDING

A Bacolod Regional Trial Court judge has dismissed the complaint of illegal possession of firearms filed against a Negrense claiming to be the world commander of the International Police.

RTC Judge Pepito Gellada yesterday said he dismissed the case for illegal possession of a firearm against Julio Quirino, because it is already included in a direct assault case he is facing.

The Supreme Court, in the case of People versus Ladjaalam, stated that "if an unlicensed firearm is used in the commission of any crime, there can be no separate offense of simple illegal possession of firearms."

The judge noted that Quirino is facing another charge of "direct assault" before the Municipal Trial Court in Cities Branch 6 of Bacolod City.

The police accused Quirino of staging an assault on Precinct 3 in Bacolod City on February 2 to demand the release of one of his men who was allegedly involved in a traffic accident.

He also allegedly drew his .45 caliber revolver but before he could fire it, one of the policemen parried his weapon, the police said.*CPG
